Regulated professions: compliance with competition law and proportionality
Thierry BONTINCK, partner of the European Law and Competition team, will present the March Breakfast at Stefany’s with Thaïs PAYAN.
For several years, the vice has been tightening around the regulated professions. The European Commission, largely followed by various national competition authorities, considers that the regulations of professions are too restrictive and do not protect the interest of consumers or the general interest, but often the corporatist interests of the profession concerned.
Legal proceedings have been initiated by the European Commission itself or by national authorities resulting in substantial fines for various representatives of the professions. The Commission has issued various communications and, since 2020, the proportionality directive requires that a rigorous test be carried out before any new regulation is adopted.
The speakers will take stock of the various obligations and will also discuss the room for manoeuvre left to the representatives of these professions and to the public authorities that regulate them in a framework that is becoming increasingly deregulated.
