Protection of personal data

DALDEWOLF SRL/BV acts as a data controller when processing the personal data of its clients, opponents, other lawyers, judges, bailiffs, potential clients, suppliers, partners, applicants or other third parties (“data subjects”). We use personal data provided by you, such as your name, company, email address, registered office address, telephone number and, if you are a client, information relating to your file.

Client records. DALDEWOLF processes your personal data for a number of purposes, such as processing your file, invoicing our services, collecting debts if necessary, archiving and deleting data, as part of the performance of the contract we have with you. If you are a natural person representing a company that is our client, we may process your personal data on the basis of the legitimate interests of our client and DALDEWOLF (i.e. in order to provide the services for which you have retained us). Individuals representing our clients will receive our newsletters and invitations but are free to unsubscribe at any time and without charge. We process the personal data of other data subjects (e.g. adversaries, bailiffs, other parties, judges, …) on the basis of the legitimate interests of our clients and DALDEWOLF (i.e. processing of the file, negotiation of contracts, implementation of legal proceedings, preparation of legal advice, …).

DALDEWOLF may transfer personal data to third parties (such as courts, bailiffs, adversaries, subcontractors such as IT service providers) when required by our clients’ cases.

We will retain the personal data relating to your file for as long as it is being processed. We will archive the file (and the personal data it contains) when it is closed and we will destroy it 5 years after it is closed (unless a dispute has arisen and we need the data to defend our rights). Under the rules of our profession, we are required to retain certain data (such as the identity of clients) in order to check for conflicts of interest and to ensure compliance with professional secrecy.

Recruitment. DALDEWOLF processes personal data for recruitment purposes, based on its legitimate interests and those of the applicant. DALDEWOLF does not transfer your personal data (as a candidate) to third parties.

DALDEWOLF will retain your personal data for the duration of the recruitment process. We delete the personal data of candidates to whom no job offer has been made.

Information and communication. DALDEWOLF also processes personal data for business development and marketing purposes. If you have registered, you will receive our newsletter and be invited to events we organise. You give us your consent to this processing of your data, which you can withdraw at any time and without charge. DALDEWOLF will pass on your personal data to third parties, namely subcontractors and, on the occasion of events, to other participants in order to facilitate networking. In order to send you our newsletters, we use the services of MailChimp, a company based in the USA, which may transfer your personal data to the USA. Mailchimp is committed to ensuring an adequate level of protection for your personal data by complying with the Privacy Shield principles. DALDEWOLF retains your data until you unsubscribe or withdraw your consent to the processing of your personal data.

Personal data under our control may be transferred to subcontractors (such as IT service providers or other consultants) or other data controllers (e.g. other lawyers) where strictly necessary for the purpose of processing our clients’ files.

Your personal data will be made available to our office in Kinshasa (DRC), which is bound by standard contractual clauses for the transfer of personal data to third countries (Commission Decision No 2004/915 amending Decision No 2001/497). We have no intention of transferring personal data to other countries outside the EEA, but this may be necessary in specific cases and we will take appropriate measures to protect your rights and interests.

As a data subject, you have the right to request access to your personal data, rectification or erasure of your data, restriction of processing, portability of your data.  You have the right to object to the processing of your data for reasons relating to your particular situation. DALDEWOLF will do its best to respond to your request as soon as possible, also respecting its obligations of professional secrecy and protection of confidential data. You can exercise your rights by sending us an email to dataprotection@daldewolf.com, providing proof of your identity.

As a data subject, you have the right to lodge a complaint with the competent supervisory authority.
