Op basis daarvan zou de Europese Commissie de bevoegdheid krijgen om grote overheidsopdrachten of concentraties met een bedrijf dat buitenlandse subsidies heeft ontvangen die de interne markt verstoren, te blokkeren, of althans om dergelijke verstorende effecten te verhelpen. De Europese Commissie zou ook het recht hebben om elke andere markttransactie waarbij een dergelijk bedrijf betrokken is, te onderzoeken en de verstoringen te laten verhelpen.
