Dat is nu gebeurd met het recente <a href=\"https:\/\/www.dekamer.be\/flwb\/pdf\/55\/3231\/55K3231001.pdf\" target=\"_blank\" rel=\"noopener\">wetsvoorstel van 20 maart 2023<\/a>.<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright\" src=\"https:\/\/www.daldewolf.com\/wp-content\/uploads\/2020\/05\/GEVERS-Raphae%CC%88l-1-400x280.jpg\" alt=\"\" width=\"300\" height=\"210\" \/>De wetgevers in Europa en Belgi\u00eb hebben als doel de procedures voor het behoud van ondernemingsactiviteiten in tijden van financi\u00eble problemen te versterken.<\/p>\n<p>Het arsenaal aan instrumenten voor het onderhandelen over akkoorden met schuldeisers is aanzienlijk uitgebreid.<\/p>\n<p>Daarnaast heeft de wetgever ervoor gezorgd dat de kwaliteit van de financi\u00eble informatie die ondernemingen in moeilijkheden moeten verstrekken, is verbeterd.<\/p>\n<p>De kaders en overeenkomsten voor preventieve herstructurering, die binnenkort worden ge\u00efntroduceerd, zijn flexibel van aard en zijn ontworpen om optimaal te voldoen aan de specifieke behoeften van elke onderneming.<\/p>\n<p>Bovendien is de vroegtijdige waarschuwing van ondernemingen in moeilijkheden versterkt, onder meer door de verplichting voor accountants om hun cli\u00ebnten te waarschuwen.<\/p>\n<p>Het is ook het vermelden waard dat er in de toekomst een onderhandse (vertrouwelijke) faillissementsvoorbereidingsprocedure beschikbaar zal zijn, evenals de mogelijkheid om klassen van schuldeisers te vormen in geval van een collectief akkoord van grote ondernemingen.<\/p>\n<p>Boek XX van het Wetboek van economisch recht zal volledig in overeenstemming zijn met de Europese richtlijn zodra het wetsvoorstel wordt aangenomen en zal alle bestaande economische entiteiten (met uitzondering van overheidsbedrijven) omvatten.<\/p>\n<p>De bestuurders van deze entiteiten kunnen altijd <a href=\"https:\/\/www.daldewolf.com\/nl\/team\/raphael-gevers\/\" target=\"_blank\" rel=\"noopener\">rekenen op de expertise van de gespecialiseerde advocaten van DALDEWOLF<\/a> voor meer informatie of om gebruik te maken van deze preventieve herstructureringskaders.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Belgi\u00eb was traag om de Europese richtlijn (EU) 2019\/1023 inzake preventieve herstructureringskaders om te zetten in nationale wetgeving.
