Introduction: The Member States of the European Union cannot seek to attract investors at the expense of other countries by favouring them. For this reason, state aid law precludes Member States from granting economic advantages to companies. Therefore, when a company enters into a transaction with the public sector, it must ensure that it does not enjoy an undue advantage over other companies. This breakfast will be the opportunity for Carole MACZKOVICS to provide answers to the following questions:

  • When might a transaction with the public sector constitute an undue advantage?
  • What are the risks of benefiting from such an advantage?
